WEDNESDAY 21st March  2012 AT 7.00PM

  1.   APOLOGIES FOR ABSENCE
Apologies were received from Cllr Cartwright before her resignation was received.

2.   AN OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE TOWN COUNCIL
There were four members of the public present and Mr Lovel, representative applicant for the planning at Northgate Vale who came to give background information regarding the scheme. Mr Lovel explained that the larger application did not proceed because the land belonged to one individual. Funding for the Surgery was from the PCT and had been main committee approved. The new site had deliverable requirements a) nearer town b) parking with surgery building c) cycle and footpath link which mean residents could walk and not drive. Mr Lovel also explained that if the PCT abolished the funding the new surgery would be lost. The surgery would be for the 8,500 residents for 30/40 years (growing to 11,000). Resident he knew had asked about the rerouting of traffic and screening along the boundaries. Mr Lovel stated that there was a lower density than those previous proposed. Residents were very concerned about the increase in vehicles on Northgate Vale. The current surgery in the town centre had considerable parking problems.  Cllr Rudd asked about access to the main entrance and Mr Lovel replied that the main entrance had to remain but the construction traffic could be re-routed via the Industrial Estate. There was some discussion about the specification in the meeting held the evening before. Cllr Hemmerman asked about the Health Centre pharmacy being open until 11pm. Mr Lovel stated this is the licence only available on a 100 hours licence. With regard to drug users he felt as there were not many registered in the area but he could probably get the drug user element of this removed. Cllr Rudd asked about the using the existing entrance on Holme Road. Mr Lovel stated this was not deliverable due to the landowners not progressing so therefore not feasible. After negotiations with East Riding Planners Mr Lovel stated they were prepared to give a pro rata sum per dwelling to contribute to the roundabout and this had been agreed on. Cllr Macqualter stated that an application for Skelton Crescent being an access road had been turned down as it was too narrow and Northgate Vale was the same. Mr Lovel stated that there was a new manual for street and highway capacity. Cllr Hemmerman stated it was undesirable for residents. Cllr Chicken asked for clarification regarding access for Northgate Vale. Mr Lovel stated that the money they would put in the pot for the roundabout was £2,000 per dwelling. 

A resident who lives at Ingle Court, Beverley Road, stated he was concerned about coming out of Ingle Court due to the amount of cars parked in both directions. Councillors explained that they had been trying for two years to get double yellow lines in that area up to the fledgling building but it was still in progress. The gentleman also asked about on road parking and was informed that checking used to be the responsibility of the Police but that East Riding of Yorkshire Council Wardens turn up now and again on an ad hoc basis. Enforcement was always a problem. The resident also stated that he was concerned that the lock was not going to be replaced on the allotment site. He informed Councillors that Pocklington had a large metal gate with a rota system for gate opening and the lock was welded to a chain welded to the gate. The resident was informed that it was hoping to get an allotment association going and that had been one of the suggestions. Councillors suggested that this be brought up at the Cemetery and Parks Meeting on the 4th April.

A resident asked about the removal of the pig farm planning condition as at that end planning it is not viable but is still going ahead despite being told not viable.

3.   DECLARATIONS OF A PERSONAL AND PREJUDICIAL INTEREST – Members to declare any interest in items on the Agenda and the nature of those interest.
Cllrs King, Townshend and Macqualter signed the book and declared a personal and prejudicial interest in all matters relating to community hall and Cllrs Frith and Hemmerman signed the book and declared a personal and prejudicial interest in all matters relating to the Holme Road development.

4.    MINUTES OF THE MARKET WEIGHTON TOWN COUNCIL MEETING HELD ON WEDNESDAY 22ND FEBRUARY 2012
It was proposed by Cllr Macqualter and seconded by Cllr Frith  that the previous Minutes be signed as a true and correct record.  AGREED.

5.   ONGOING MATTERS AND  PROGRESS  REPORTS – Town Clerk
Folio 6320 – With regard to the decision about no fires on the allotments a resident from Princess Road has e mailed to say that the allotments suffered from a prolific weed and slashing and burning was the only thing that destroyed plant and seed and had therefore asked if an amendment could be made. The Clerk had told the resident that no other allotment holder had mentioned this and a year where fires had been allowed should have enabled this event to happen to get rid of these weeds as stated. As the agreements had now gone out The Clerk thought a retraction would not be possible but would pass his concerns to the regular meeting.
Folio 6320 – The snow blower had been returned to MW Farm Supplies and another machine was in the process of being located.
As members of the public were present to hear the outcome of the Planning application it was agreed that item 15 and 16 be brought forward.

15.    TO CONSIDER PLANNING APPLICATIONS

DC/12/00891/STPLF,  Lovel Development (Yorkshire) Ltd, c/o Mr Philip Lovel, 22 Molescroft Road, Beverley, East Riding Of Yorkshire, HU17 7ED.  Strategic – Full Planning Permission: Erection of 49 no. dwellings and Health & Social Care Centre with associated access at: Land North of Market Weighton Lawn Tennis Club, Holme Road, Market Weighton, East Riding Of Yorkshire,
Level: Delegated
MWTC proposed to RECOMMEND REFUSAL of this application for the following reasons:
1. The council have received several objections from residents and a public meeting held on Tuesday 21st March, resulted in a petition soon to be handed to ERYC
2. The current Local Development plan for MK11 land  prohibits the use of Northgate Vale for access other than for emergency vehicles
3. Whilst residents are in favour of a new health centre the late night opening of the pharmacy for possible drug related dispensing was not acceptable in a residential area
4. Objections by a serving police officer indicated that access to Northgate Vale is too narrow to accept a higher volume of traffic and would become severely congested and dangerous for families with young children.
5. Local development plan for Mk11 land requires drainage to be away from the existing system, these plans indicate using the same drainage as Northgate Vale which already floods in heavy rain.
6. Local development plan for Mk11 requires this land to be developed as a whole and not in part.
7. The tennis club access from Holme Road to the Health centre is private land with no public right of way except access for a farmer to maintain the field in the past. If this access is used, lack of adequate parking at the Health Centre would result in congested parking on Holme Road.
8. The proposal to use this access as a combined pedestrian, cycle and vehicular access is believed contrary to highway regulations
9. An independent planning consultant has indicated that the proposals are contrary to government guidance PPS1, PPS3 and PPG13 and should be refused.
If officers are minded to disagree with MWTC Councillors they ask that it to go to Committee in view of the response received from residents.  21.03.2012

6.    TO REVIEW THE STARTING TIMES OF MARKET WEIGHTON TOWN COUNCIL MEETING
Cllr Hemmerman asked how Councillors felt at moving the times of the meeting from 7pm to 7.30pm. Councillor Stellings stated that when the meetings had been moved to 7pm he had objected as he works out of town but that he had altered his schedule to allow for this. By having the meetings start later they would automatically finish later which would impact on everyone included the staff and proposed that they remain unchanged. All were in favour that the time remain at 7pm for the commencement of meetings. AGREED.

7.    TO DISCUSS THE CURRENT POSITION WITH REGARD TO FILLING THE VACANCY FOR A TOWN COUNCILLOR
The Clerk stated that there would be an Election if contested on the 26th April. Nomination packs were available from ERYC or would be from MWTC in the next few days. Notice of the Election has been placed on the board outside the Town Hall.  Another resignation received meant that a notice of vacancy had to go up again and could not be part of the current requested election. It was hoped that the second vacancy could be filled by co-option so that a second election did not have to be paid for. All co-option requesters’ had been written to saying that nomination packs were available.

8.   TO DISCUSS ANY RESPONSE FROM THE PORTAS PILOT INFORMATION SENT OUT TO LOCAL SHOPS AND BUSINESSES
Four businesses had written showing an interest in the Portas Pilot and therefore the Clerk was to complete the form requesting funding and send it by e mail the following day – the deadline being the 30th March. The Clerk is also to write to all those that showed an interest in order to find out availability and set up a meeting with Cllr Hemmerman and any other available Councillor.

Events 14th March 2012  -  It was AGREED to recommend to full Council that:
•  The bus for the Friday market should no longer be subsidized by the MWTC
•  The Friday market be discontinued at the end of March through lack of interest but that the lady with the chiropody van be allowed to continue to park her van on the car park for existing customers
•  That all catering events this year be done by our best used supplier due to these being best value for money and that in future quotes be asked for at the beginning of each year for the whole years events

The Clerk was asked to check on the payment for window cleaning especially in view of the current window cleaner being from out of town. – a local person might be more cost effective. As a member of the public was present it was agreed that a note of the balances on the accounts was not read out by the Clerk. The financial reports were accepted.

13.   REQUESTS FOR DONATIONS
There was a request for donation from the Community Hall towards the refurbishment of the kitchen and toilet facilities at the hall. WREN was also being asked for funding but they needed to know that local organisations in the town were in full support of this. Cllr Peaks proposed and Cllr Botting seconded that £100 be sent in order to support this. AGREED. The Clerk was asked to write a letter of support when the cheque was sent.

14.   FORTHCOMING EVENTS DIARY AND REPORTS FROM LAST MEETING
The events diary was passed to all. Any items intended for inclusion should be sent to the Town Clerk. When an invite is received through the post it will automatically be included and only be marked ‘not attending’ where appropriate.  It was noted by all that the Mayor and Mayoress had been very busy attending functions and representing the Market Weighton Town Council. Cllr Chicken was due to attend some events in the future.

17.   TO DISCUSS ANY RELEVANT COMMITTEE AND COMMUNITY ISSUES
Cllr Townshend – stated that he had been to the Nature Reserve and the fence to the left as you go in was leaning outwards. The Clerk stated this was in hand and the Handyman was due to make this repair in the next few days. It had been uncertain whose fence it was but it was thought it was in the Councils best interest to make the repair. Cllr Townshend also asked about the additional bus stop on Holme Road. The Clerk stated she would chase this up but there had been some correspondence.

Cllr Frith – Asked about progress on the Willow Tree overhanging. The Clerk stated that a tree officer had gone out and that the tree was not dangerous – the noise was two boughs rubbing together. The responsibility was that of the riparian owner but that the resident complaining could arrange for any overhanging branches to be cut as long as the pieces were offered to the riparian owner. Cllr Frith stated the resident was an elderly gentleman and could not do this job. Unfortunately this was not able to be done by the Town Council Handyman as a chain saw would be needed and we would have to pay for someone to do this. Cllr Frith stated that a gentleman had called in on Friday afternoon to pay his allotment rent and would come in after his holidays. The Clerk noted this information with the plot number and name.

Cllr Peaks – Informed Councillors that many rumours were flying around about the senior school closing and was this true. Cllr Rudd explained that this was not true and good news would be heard by all in due course. Cllr Peaks had heard that some jobs may be going. Cllr Rudd stated that staff structures were being looked at. This was due to management decisions not lack of provision. That some admin staff would have to be cut but no essential staff would go (some staff may have to reapply for their posts) this was to ensure the most cost effective position they could. Cllr Rudd stated that in fact they were bringing in more teaching staff. There had been a deficit for some time and this needed sorting out. Cllr Rudd stated there was to be a Press Release shortly which would scotch the rumours. Cllr Peaks also said that the LPM had been excellent with many stalls and garland dancers and that the Market organiser should be thanked for her efforts. Cllr Rudd thought this should be a verbal thank you or better still by letter.

Cllr Chicken – Informed Councillors that a house next to the War Memorial Playing Field had a fence right down to the beck and in fact over hanged it a little. Cllr Hemmerman was to meet the Enforcement the following day and would ask him to take a look at it and if there was a problem the Clerk would report to the EA.

Cllr Hemmerman – stated that he was meeting the Enforcement officer the following day to look at the end of a garden on Holme Road as it was felt the resident had lost some of her garden due to the development. Cllr Hemmerman also mentioned his attendance at the Kiplingcotes Derby and stated they had a problem now with funds and whilst maybe would be ok for next year the trustees were not sure what would happen after that and it was thought that Market Weighton town Council could look at this in the near future. Cllr Hemmerman also mentioned that the Travel Shop had closed quite suddenly.

18.  DATE OF NEXT REGULAR MEETING OF MARKET WEIGHTON TOWN COUNCIL
The next Meeting of Market Weighton Town Council will be held on Wednesday 18th April 2012 at 7.00pm in the Council Chamber. This will be the Annual Meeting.
There being no further business to discuss, the Town Mayor thanked Members for their attendance and declared the Meeting closed at 9.22pm.
